Michigan Criminal Background Checks for Health Care Facilities

Nursing homes, county medical care facilities, hospitals with swing bed services, Medicare-certified home health agencies, intermediate care facilities for mentally retarded, and psychiatric facilities and inpatient programs shall comply with Section 333.20173a of the Public Health Code (P.A. 368 of 1978) and Section 330.1134a of the Mental Health Code (P.A. 258 of 1974). These laws state that criminal background checks, including fingerprint checks, be conducted for staff hired after April 1, 2006. Individuals who have regular direct access to patients and/or their medical records or provide direct services to patients, including independent contractors and those with clinical privileges, are to be included.

Facility/agency employees hired prior to April 1, 2006 are considered "exempt" but must complete a form agreeing to "self report" arraignments and convictions as do new hires. Exempt staff will also be required to submit fingerprints for the health care worker database as a condition of continued employment at a time to be determined by legislation.

The Michigan Long Term Care Partnership for Workforce Background Checks Program coordinates compliance of this 2006 legislation. The toll-free number for the Program is 1-877-718-5547; the website is http://www.miltcpartnership.org and provides access to the computer program used to conduct background checks.
