STATE OFFICE OF ADMINISTRATIVE HEARINGS AND RULES FOR THE DEPARTMENT OF COMMUNITY HEALTH

The State Office of Administrative Hearings and Rules for the Department of Community Health holds a variety of administrative hearings when decisions by the Department of Community Health and its contract agencies are contested. The The State Office of Administrative Hearings and Rules for the Department of Community Health receives over 5,000 hearing requests per year regarding numerous Department programs.

 

Statement of Purpose

 

The The State Office of Administrative Hearings and Rules for the Department of Community Health provides an administrative hearing to appellants requesting a hearing who do not agree with a decision made by the Department of Community Health (DCH) or a DCH contracted agency; i.e., any agency, organization or health plan contracted by the Department that either determines eligibility for a department program, or delivers a service provided under a department program to a beneficiary, patient or resident. The The State Office of Administrative Hearings and Rules for the Department of Community Health issues timely, clear, concise and legally accurate hearing decisions and orders.

 

Goals and Objectives

  • To schedule administrative hearings within 30 days of receipt of request for hearing.
  • To issue decisions and orders within 30 days from the date of the hearing or from the date the hearing record is closed.
  • To provide responses to questions regarding the administrative hearings process promptly, politely and accurately.
  • To conduct administrative hearings in a fair, unbiased manner.
  • To issue decisions and orders based upon accurate facts and appropriate legal authority.
